In a recent court ruling, it was reaffirmed that national and store brand suppliers have the right to compete and may not abuse the marketplace with misleading advertising practices.
The court case centered on infant formula brands. Mead Johnson Nutrition Co, the makers of Enfamil Lipil, who used a consumer mailing to tout the superiority of its formula vs storebrandformula.com. Those mailings, opened the door for PBM, Pergio’s, store brand infant formula makers, to win a 13.5 million dollar false advertising claim against the makers of Enfamil. Store brand infant formula contains the same nutrients at the same levels as Enfamil brand formula, so touting superiority was deemed false and misleading. You can read here for more information
If you use infant formula, do you practice brand loyalty? It has been many years since, infant formula was on my shopping list. I must admit, I did have a specific brand loyalty when I purchased formula for my first child. I have 3 children, so when child #2 and #3 used formula, I was a more relaxed Mommy, so I experimented and used both name and store brand formulas.
In today’s market there are so many infant formula choices, I am glad I don’t have to make that choice now.
